OVERVIEW
This year, the Pulse magazine intends to take its
celebration to a whole new level and host the second edition of Pulse Music
Video Awards. The Pulse Music Video Awards is an award presentation looking
to celebrate the Kenyan Music Industry their songs, videos, producers,
directors among others.
The 70% people choice/audience voting will be done online as well as through
SMS voting. There will be a website where all the nominees' music videos
will be uploaded for the audience to view and vote. The highest number of
votes per video will then be selected. We will partner with either Deloitte,
KPMG, Viva Africa or PKF to verifying the auditing of the votes.
Responsibility
Decisions of The Standard Group Limited are final and binding. The Standard
Group Limited is not responsible for any failure of the website during these
Awards. Nor is it responsible for any problems or technical malfunctions of
computer online systems, IVR telephone systems, SMS delivery systems,
servers, access providers, computer equipment, software or any entries lost
due to technical problems or traffic congestion on the IVR telephone system
and SMS vote delivery system or any combination thereof, including any
injury or damage to an entrant's or any other person's telephone or property
related to or resulting from playing or downloading any material in the
Awards.
The Standard Group Limited reserves the right, at its sole discretion, to
cancel, terminate, modify or suspend this Awards or any portion hereof at
any time for any or no reason, or to disqualify any individual implicated in
any of the following actions, if for any reason: (a) infection by computer
virus, bugs, tampering, unauthorized intervention, actions by Entrants,
fraud, technical failures, or any other causes which, in The Standard Group
Limited opinion, corrupt or affect the administration, security, fairness,
integrity or proper conduct of the Awards, (b) the Awards or any website
associated therewith (or any portion thereof) becomes corrupted, or (c) the
Awards is otherwise not capable of running as planned
By entering, Entrants agree to release and hold harmless The Standard Group
Limited and their affiliates, from and against any and all claims, actions
and/or liability for any violation of the Terms and Conditions by Entrants
(including any warranties made by Entrants), any injuries or death, loss or
damage of any kind arising from or in connection with participation in
and/or submission of an entry into the Awards. The Released Parties are not
responsible or liable for any incorrect or inaccurate Submission
information, and assume no responsibility for (i) any error, omission,
interruption, defect or delay in operation or transmission, (ii) failure of
any entry to be received due to technical problems, human error or traffic
congestion on the IVR entry line, (iii) communications line, hardware and/or
software failures, (iv) damage to any computer (software or hardware)
resulting from participation in the contest, or (v) theft or destruction of,
tampering with, unauthorized access to, or alteration of Submission and/or
information. By making a submission into these Awards, Entrants agree to
comply with these Terms and Conditions
Prizes
The winners of the awards will receive a trophy as a token of appreciation on
the day of the event. No other prizes will be offered during the
Awards.
Prize conditions
The prize must be accepted as awarded and may not be used in conjunction with
any other offer or promotion, sold, redeemed for cash, combined with any
other promotion or exchanged for a different prize.
By accepting a prize, the winner of the Awards agrees to hold The Standard
Group Limited and their respective agencies, affiliates, parent(s),
subsidiaries, agents, advertising and promotion agencies and/or anyone else
involved in the development, production and/or handling of the Awards and
their respective directors, officers, employees and assigns, harmless
against any and all claims and liability arising out acceptance or use of a
prize.
In order to be declared a winner, the selected entrant must sign and return a
declaration and release form confirming eligibility and compliance with
these Awards Terms and Conditions, consenting to the use, without further
compensation, of winner's name, address (city only) and mobile song(s) in
any Awards-related publicity and releasing The Standard Group Limited and
their respective affiliates, parent(s), subsidiaries, agents, advertising
and promotion agencies and/or anyone else involved in the development,
production or handling of the Awards and their respective directors,
officers, employees and assigns from all liability arising in connection
with the Awards or the acceptance, use or redemption of a Prize was awarded.
The declaration and release must be returned to The Standard Group Limited
within 10 (ten) days after receipt of the declaration and release from The
Standard Group Limited. Entrants who fail or are unable to meet any of these
Terms and Conditions may be disqualified and alternate winner(s) will be
selected.
Voting Terms & Conditions
Interactive audience voting will be set-up by The Standard Group Limited to
enable pulse fans to vote for their favourite top 5 (five) nominees in each
category in the Pulse Music Video Awards 2021. The voting has been set up to
encourage public participation in the Competition.
After the Submission Period, 4 (four) nominees will be selected by the judges
and the Voting Period will begin soon thereafter. During the Voting Period
members of the public will be called upon to vote for their favourite
contestant chosen from among the 4 (four) nominees in each category. This
will also be done through SMS sent to 22845. The fee per vote entered by the
public will be Kshs 10.
SMS Voting
You may vote by sending an SMS vote for your favourite top 4 (four) nominees.
You will have to text the keyword ,PMVA? followed by the nominee per
category number e.g. "PMVA00"” to 22845. This will be done through SMS sent
to 22845. The fee per vote entered will be Kshs. 1 and bundled SMS do not
apply.
Unrecognised SMSs (SMSs where the text does not match the required voting
text format or cannot be allocated to a specific Entrant) will be charged
for but not counted and the subscriber who sent the SMS will not be eligible
for any of the prizes.
Participants are not allowed to use machines that automatically send SMS
messages or automate/facilitate the answer process or any other alternative
way of sending SMS messages, other than a mobile phone containing a
registered SIM card. The Standard Group Limited has the right to disqualify
any Participant it suspects of violating this condition.
The Standard Group Limited reserves the right to change these Terms and
Conditions at any time, and may suspend, withdraw or re-set voting at its
sole discretion. Where The Standard Group Limited does change these Terms
and Conditions, this will be communicated on the The Standard Group Limited
Kenya website www.standardmedia.co.ke
The Standard Group Limited reserves the right to disqualify votes if it has
reasonable grounds to suspect that there has been any attempt to manipulate
the voting fraudulently.
After the SMS voting has closed, the result of the vote will be established
from all votes received. Late votes, or votes not received by the time the
result is calculated, will not be counted but will be charged by your
service provider where applicable.
The Standard Group Limited, including their holding and subsidiary companies,
affiliates, employees, agents and sub-contractors ("the Indemnified
Persons") do not accept any responsibility whatsoever for any technical
failure or malfunction or any other problem with any mobile network, system,
server, provider, software or otherwise which may result in any vote being
lost or not properly received, registered or recorded or not being received
on or before the closing time.
The Standard Group Limited is committed to a fair voting process and to
preventing abuse of its systems, as well as those of its agents, affiliates
and sub-contractors. However, The Standard Group Limited does not guarantee
that the mobile network and other networks used in connection with voting
will be free from errors or omissions nor that they will be available
uninterrupted and in a fully operating condition. In the case of system
failure or repair or for reasons beyond the reasonable control of The
Standard Group Limited, the system and/or voting service may be suspended
temporarily and without notice. The Indemnified Persons will not be liable
to any person in the event that all or any part of the system and/or voting
service is discontinued, modified or interrupted in any way.
The Standard Group Limited will not have a say in the outcome of the vote.
The nominee per category with the most votes and best judged singing quality
by the panel of judges from The Standard Group Limited will automatically
emerge as the winners. In the event that the vote outcome cannot be
reasonably determined (due to a technical failure or other circumstance
beyond The Standard Group Limited's reasonable control and the data is
irrecoverable), then The Standard Group Limited may postpone the result or
exclude the results from the system that failed, unless the data can be
recovered.
The Standard Group Limited reserves the right to amend these terms and
conditions on notice. Any change will be posted on this website and such
posting shall be adequate notice to all participants in the voting.
Accordingly, you hereby undertake to check these Terms and Conditions each
time you wish to vote.
These Terms and Conditions shall be governed by the Laws of Kenya.
CAUTION: The Standard Group Limited does
not require subscribers to send airtime, money or any other consideration in
order to collect prizes and will not be liable for any losses or other
damage
